3PL's, Brokers & Other Intermediaries Third-party logistics providers, transportation brokers and other intermediaries play an important role in the supply chain. Panelists will discuss legal considerations in dealing with different kinds of intermediaries, regulatory requirements for licensing, bonds and insurance, liability of intermediaries for loss & damage in transit, liability of shippers and consignees for freight charges; how to avoid common problems through due diligence and proper contracts.

Loss & Damage Claims - A Short Course How to prepare and file a claim; supporting documentation; measure of damages and duty to mitigate loss; Dealing with special situations - concealed loss and damage; "SL&C" and palletized shipments; food and drug products; broken or missing seals; salvage issues including product liability, brand & trademark considerations. "A picture is worth a 1000 words" and can be the evidence you need in a difficult situation. Shippers and carriers will learn how to use the camera when confronted with employee theft, cargo loss & damage, security breaches, personal injury and workers' comp claims. Catching it on video is hard to beat, and there is no betta "Gotch". In this session experts will demonstrate video evidence that turned the tide in actual cases.

International Transportation and Multimodal Transportation
Different laws govern international and multimodal transportation. Experts will explain liability regimes governing air, ocean and cross-border cargo movements, the role of multimodal service providers and intermediaries and their liability limitations, time limits for claims and suits, Himalaya clauses, Incoterms, risk of loss, cargo insurance.

Preventing Freight Loss and Damage
The session will include a discussion of NMFC packaging rules, rail intermodal loading guides, proper blocking, bracing and packaging techniques, use of recording devices. An actual case history will be included to illustrate a shipper and a carrier working together to solve a packaging problem.

Skilled transportation trial lawyers will conduct an interactive workshop explaining how to effectively testify at a deposition.
